Terms and Conditions

The Designer Coach®

1. Introduction

These Terms and Conditions govern the coaching services provided by Lisa Jayne Grant trading as The Designer Coach® (hereinafter referred to as “Coach”, “we”, “our”, or “us”) to the client (hereinafter referred to as “Client”, “you”, or “your”). By engaging our services, you agree to be bound by these Terms and Conditions.

2. Coaching Services

2.1 Description of Coaching
Coaching is a partnership between the Coach and the Client in a thought-provoking and creative process that inspires the client to maximise their personal and professional potential. It is designed to facilitate the creation and development of personal, professional, or business goals and to develop and carry out a strategy for achieving those goals.

2.2 Nature of Services
Our coaching services are tailored for passionate designers seeking to unlock their full potential. We offer a unique journey of self-discovery and skill enhancement, blending extensive industry experience with holistic personal development techniques.

2.3 Scope of Services
The specific scope of coaching services will be agreed upon between the Coach and the Client and may include, but is not limited to:
– Career development strategies
– Creative skill enhancement
– Personal branding for designers
– Work-life balance optimisation
– Business development for freelance designers
– Leadership skills for creative professionals

3. Coach-Client Relationship

3.1 Coach’s Commitments
A. The Coach agrees to maintain the ethics and standards of behaviour established by the International Coach Federation (ICF). The Client is encouraged to review the ICF Code of Ethics (coachfederation.org/ethics).

B. The Coach commits to maintaining confidentiality in accordance with Section 7 of these Terms and Conditions.

C. The Coach will provide a supportive, inclusive, and inspiring environment where the Client can explore, experiment, and grow.

3.2 Client’s Responsibilities
A. The Client is solely responsible for creating and implementing their own physical, mental, and emotional well-being, decisions, choices, actions, and results arising out of or resulting from the coaching relationship and coaching interactions.

B. The Client agrees that the Coach is not and will not be liable or responsible for any actions or inaction, or for any direct or indirect result of any services provided by the Coach.

C. The Client understands that coaching is not therapy and does not substitute for therapy if needed, and does not prevent, cure, or treat any mental disorder or medical disease.

D. The Client acknowledges that coaching is a comprehensive process that may involve different areas of their life, including work, finances, health, relationships, education, and recreation. The Client agrees that deciding how to handle these issues, incorporate coaching principles into those areas, and implementing choices is exclusively the Client’s responsibility.

E. The Client agrees to communicate honestly, be open to feedback and assistance, and create the time and energy to participate fully in the programme.

4. Services and Fees

4.1 Coaching Programme
The specific details of the coaching programme, including duration, frequency of sessions, session length, and method of delivery, will be outlined in the separate Coaching Agreement signed by both parties. This Agreement will be tailored to the specific package chosen by the Client.

4.2 Additional Support
The Coach will be available to the Client by email and voicemail between scheduled meetings, subject to reasonable limits defined by the Coach. Additional support time may be available upon request at a prorated fee based on the Coach’s hourly rate.

4.3 Fees and Payment
A. The fee for the coaching programme will be as specified in the Coaching Agreement, which will also outline the payment terms (e.g., in full in advance, monthly instalments).

B. For any additional services not covered in the Coaching Agreement, including pay-as-you-go sessions, the fee will be as per the Coach’s current rate card, which will be provided to the Client upon request.

C. Payment is due as specified in the Coaching Agreement.

D. Accepted payment methods will be outlined in the Coaching Agreement.

4.4 Rescheduling and Cancellation
A. The Client agrees to provide at least 48 hours’ notice for rescheduling or cancelling a session.

B. Late cancellations (less than 48 hours’ notice) or no-shows will be charged at the full session rate.

C. The Coach reserves the right to reschedule sessions with 48 hours’ notice. In case of emergency cancellations by the Coach, a make-up session will be scheduled as soon as possible at no extra charge to the Client.

5. Refund Policy

The Coach is committed to client satisfaction. However, due to the nature of coaching services, refunds are generally not provided. In exceptional circumstances, refunds may be considered on a case-by-case basis at the Coach’s discretion. Clients are encouraged to communicate any concerns promptly to allow for resolution.

6. Procedure for Coaching Sessions

A. The time and/or location of coaching sessions will be determined by mutual agreement between the Coach and the Client.

B. For remote sessions, the Client will initiate the call at the scheduled time using the contact details provided by the Coach.

C. If the Coach needs to be reached at a different number for a scheduled call, the Client will be notified in advance.

7. Confidentiality

7.1 Coach’s Commitment to Confidentiality
A. The Coach agrees to maintain the confidentiality of all information shared by the Client during the coaching relationship, in accordance with the ICF Code of Ethics.

B. The Coach will not disclose any information pertaining to the Client without the Client’s written consent, except as required by law or court order.

7.2 Limits of Confidentiality
Confidential Information does not include information that:
a) Was in the Coach’s possession prior to being furnished by the Client;
b) Is generally known to the public or in the Client’s industry;
c) Is obtained by the Coach from a third party, without breach of any obligation to the Client;
d) Is independently developed by the Coach without use of or reference to the Client’s confidential information;
e) The Coach is required by statute, lawfully issued subpoena, or by court order to disclose;
f) Is disclosed to the Coach and as a result of such disclosure the Coach reasonably believes there to be an imminent or likely risk of danger or harm to the Client or others;
g) Involves illegal activity.

7.3 Client’s Obligation
The Client acknowledges their continuing obligation to raise any confidentiality questions or concerns with the Coach in a timely manner.

7.4 Use of Client Information for Coach Development
A. The Coach may engage in training and continuing education pursuing and/or maintaining ICF Credentials. This process may require the sharing of Client names and contact information with ICF staff members for possible verification. By agreeing to these Terms and Conditions, the Client consents to this limited sharing of information.

B. Topics discussed in coaching sessions may be anonymously and hypothetically shared with other coaching professionals for training, supervision, mentoring, evaluation, and coach professional development and/or consultation purposes.

8. Intellectual Property

8.1 Ownership of Materials
Any materials, including but not limited to worksheets, templates, and exercises, provided by the Coach during the coaching programme remain the intellectual property of the Coach. The Client is granted a non-exclusive, non-transferable licence to use these materials for their personal development during and after the coaching programme.

8.2 Restrictions on Use
The Client agrees not to reproduce, distribute, or create derivative works based on the Coach’s materials without explicit written permission from the Coach.

9. Termination

9.1 Termination by Client
The Client may terminate the coaching agreement at any time with 30 days’ written notice.

9.2 Termination by Coach
The Coach may terminate the coaching agreement at any time with 30 days’ written notice if they believe the coaching is no longer the appropriate course of action for the Client or if the Client breaches these Terms and Conditions.

9.3 Fees Upon Termination
In the event of termination, the Client agrees to compensate the Coach for all coaching services rendered through and including the effective date of termination.

10. Limitation of Liability

10.1 No Guarantees
The Coach makes no guarantees, representations, or warranties of any kind or nature, express or implied, with respect to the coaching services provided.

10.2 Limitation of Liability
Except as expressly provided in this Agreement, in no event shall the Coach be liable to the Client for any indirect, consequential, or special damages. Notwithstanding any damages that the Client may incur, the Coach’s entire liability under this Agreement, and the Client’s exclusive remedy, shall be limited to the amount actually paid by the Client to the Coach for all coaching services rendered through and including the termination date.

11. Dispute Resolution

If a dispute arises out of these Terms and Conditions that cannot be resolved by mutual consent, the Client and Coach agree to attempt to mediate in good faith for up to 30 days after notice is given. If the dispute is not resolved through mediation, and in the event of legal action, the prevailing party shall be entitled to recover reasonable legal fees and court costs from the other party.

12. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. Any dispute arising under or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.

13. Amendments

The Coach reserves the right to amend these Terms and Conditions from time to time. Any amendments will be communicated to the Client in writing, and continued use of the coaching services after such communication constitutes acceptance of the amended Terms and Conditions.

14. Severability

If any provision of these Terms and Conditions is held to be invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law.

15. Entire Agreement

These Terms and Conditions, together with any additional agreements or contracts entered into between the Coach and the Client, constitute the entire agreement between the parties with respect to the subject matter hereof and supersede all prior agreements, understandings, and arrangements, whether oral or written, between the parties.

By engaging the services of The Designer Coach®, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
